Acceptance of Tree Fix Trading Terms

Treefix nominated trading and payment terms are accepted by customer or authorising bodies, on acceptance of quotation provided and commencement of works.

Quotes/estimates

Quotation/estimation is subject to existing site conditions (or proposed condition) at the time of quotation and ability to perform works to standard safe operating procedures, and without interruption form other entities. Refer to Changes to site/variations.

Permits and permissions

Permission, Permits, and access to remove vegetation; on private, public, or any neighbouring property, is the sole responsibility of the principal client as 'named' or 'commissioning entity/person' including liabilities for any proven lost.  
  • Please have neighbour email to Treefix their name, address and permission prior to commencement of quoted works

What we cannot see

Underground services (power, water, hidden assists etc.) are the responsibility of the client to identify to Treefix and its subcontractors. While care will be exercised by Treefix, liability for costs and repairs is the customer/clients.  

Variations/changes to site

 Treefix will report any significant variations affecting work greater than approximately 20% to nominated authorised persons, as discovered and continuance of works subject to safety and duty of care. Variations may include:
  • Extra works by request
  • Unforeseen circumstances that restrict access or work flow
  • Wet/poor conditions and forced continuation
  • Unseen/newly discovered faults, safety issues or hazardous materials that require mitigation (electrical, asbestos, tree decay/ unseen damage, provable safety risk)
  • Hazardous or protected flora and fauna (ie wasps/bees nesting birds, possums etc)
  • Reliance on other trades or services (delays, late, unfinished work etc)
  • All site inductions, safety meetings and work/job briefing held for works sites, are at Treefix nominated hourly rates. 
  • Hourly rate works: Plus 30mins mobilisation and finish time is when last truck is emptied

Payment terms

  • Private are within 3 working days of completion of works or date of invoice. Other terms available to cooperate bodies up to 30 days by prior written agreement. 
  • Government Body’s within 30 working days of completion of works or date of invoice
  • Mile stone payments as per written agreement 
  • All works over $3500 subject to 50% prestart payment
  • Alternative terms strictly by prior ‘request in writing’ to email provided
  • Payment terms of 30 days of more from end of month by agreement and incur 10% loading
  • All defaults may in incur 10% penalty per 5 working days plus administration fees after final notice.

Payment options

Preferred payment: Bank transfer 
Note payments by cash or cheque are by prior agreement only. Please advise if you require this service. (Payments by cheque/cash under $1000.00 incur a $57.20 handling fee. Please advise if you wish to use this service and we will adjust and reissue your invoice).  

Cancelations/postpones

Cancelation fees may apply to works valued over $1800 with less than 48 hours cancelation notice at minimum of 10% of quotation and 110% of any other subsequent reasonable and proven penalties/liabilities incurred for nominated works.

Damage

In the unlikely event that damage occurs:
  • Please notify us and ensure that the damage was not pre-existing 
  • If we are aware of a notable event, we will notify you and provide an incident report if required
  • No claims unless we are given first opportunity to rectify
Treefix has had 0 claims in 25 years of business (greater than $200)

On acceptance of Tree Fix quotations and work approvals; All parties agree that all contracts arise in the Australian State of which the works are to be implemented and subject to State Laws (or default to Queensland Law), Parties further agree to submit to the jurisdiction of Courts most practical and local to the delivery of works or Sunshine Coast Queensland.

Late or defaults

All defaults subject to 10% compounding per 5 working days.
Administration fees @ $88 per email

Arboriculturalists are tree specialists who use their education, knowledge, training and experience to examine trees, recommend measures to enhance the beauty and health of trees and attempt to reduce the risk of living near trees. There is no warranty or guarantee, expressed or implied, that the problems or deficiencies of the plants or property in question may not arise in the future. Arboriculturalists cannot detect every condition that could possibly lead to the structural failure of a tree. This report does not take into consideration the possibility of extreme weather or other events over which Tree Fix has no control. Trees are living organisms that fail in ways we do not fully understand. Conditions are often hidden within trees and below ground. Tree Fix and the author cannot guarantee that a tree will be healthy or safe under all circumstances, or for a specified period of time. Likewise, any remedial treatments and management practices cannot be guaranteed. Trees can be managed, but they cannot be controlled. To live or work near a tree involves some degree of risk. The only way to eliminate all risks associated with a tree is to eliminate the tree. Clients may choose to accept or disregard the recommendations of Tree Fix, or to seek additional advice.
The information contained in this report refers only to the tree/s inspected and mentioned as such within this report and reflects the condition of the tree/s at the time of the inspection. All data is based on visual inspection of the tree/s (VTA) and its/their location at the time of writing, unless otherwise stated.
Treatment, pruning and removal of trees may involve considerations beyond the scope of the Arboriculturalists services, such as property boundaries and ownership, disputes between neighbours, sight lines, landlord-tenant matters and related. Tree Fix cannot take such issues into account unless complete and accurate information is given to them. Likewise, Tree Fix cannot accept any responsibility for the authorization or non-authorization of any recommended treatment or remedial measure.
To the extent permitted by law, you agree Tree Fix is not liable to you or any person or entity for any loss of or damage caused or alleged to have been caused (including loss or damage resulting from negligence) either directly or indirectly, by use of the information made available in this report. In no event will the author or Tree Fix be liable to you for any lost revenue or profits, or for special, indirect, consequential or incidental damage (however caused and regardless of the theory of liability) arising out of or related to use of that information, even if the author has been advised of the possibility of such a loss or damage. No responsibility will be accepted by Tree Fix for unauthorised or partial use of this report.
Unless otherwise stated this report cannot be used within a court of law or any legal situation without the prior consent of Tree Fix. The author shall not be required to give testimony or to attend court by reason of this report unless subsequent contractual arrangements have been made.
